Terms and Conditions for Positive Path Mental Health LLC Services

Welcome to Positive Path Mental Health. These Terms and Conditions (“Terms”) govern your use of the services provided by Positive Path Mental Health, LLC, including but not limited to individual therapy, counseling, and mental health services. By accessing or using our services, you agree to these Terms.

Please read these Terms carefully. If you do not agree with any part of these Terms, please refrain from using our services.

1. Services Provided

Positive Path Mental Health, LLC, provides teletherapy mental health services, including individual teletherapy, group teletherapy, assessments, and counseling services. These services are intended to assist in the management and improvement of mental health conditions.

2. Client Responsibilities

  • You must provide accurate, complete, and up-to-date information to receive services.
  • You agree to attend scheduled appointments, or provide adequate notice (usually 24 hours) if you need to cancel or reschedule.
  • You are responsible for understanding the scope and nature of the services provided and communicating openly with your therapist.
  • You must follow the therapeutic plan agreed upon with your therapist.

3. Payment and Fees

  • Payment for services is required at the time of service unless otherwise agreed upon. Accepted forms of payment include [list payment methods, such as credit card, insurance, etc.].
  • You are responsible for understanding your insurance coverage, if applicable. Any co-pays, deductibles, or out-of-pocket expenses will be your responsibility.
  • If a session is missed without prior cancellation or rescheduling, a cancellation fee of $50 may apply per missed session.

4. Confidentiality

  • Positive Path Mental Health, LLC, maintains strict confidentiality of your personal and health information in compliance with the Health Insurance Portability and Accountability Act (HIPAA).
  • Confidentiality may be broken only when required by law (e.g., in cases of harm to yourself or others, or as required by court order).
  • You may request copies of your records at any time, subject to applicable laws.

5. Limits of Telehealth Services

  • If you are receiving services via telehealth, you agree to have a secure, private location for sessions, as well as a reliable internet connection.
  • While we strive to offer high-quality telehealth services, we cannot guarantee the functionality of the technology or uninterrupted service.

6. Termination of Services

  • Either you or the therapist may decide to end the therapeutic relationship at any time. You will be informed if the therapist believes the therapy is no longer beneficial for you.
  • If you decide to terminate services, you should notify your therapist in advance.
  • If fees are due for services rendered, you agree to settle any outstanding balance before termination.

7. Privacy and Data Protection

  • All personal information collected from you is confidential and will not be shared with third parties without your consent, except as required by law or with other healthcare providers involved in your care.

8. Limitation of Liability

Positive Path Mental Health, LLC, will not be liable for any damages arising from the use of or inability to use our services, including, but not limited to, emotional distress, loss of income, or other consequential damages, except as required by law.

9. Changes to Terms

Positive Path Mental Health, LLC, reserves the right to modify or update these Terms at any time. We will notify clients of any material changes. Continued use of our services constitutes your acceptance of any changes.

10. Governing Law

These Terms and Conditions are governed by the laws of Nevada, and any disputes will be resolved in the appropriate courts of Nevada.
